Falken Avionics, LLC — Falken EFB ("the App")

Falken Avionics, LLC ("Falken," "we," "us," or "our") is committed to your privacy. Consistent with our long-standing practice, we collect only the minimum data necessary to provide the App and to communicate with you. This Privacy Policy explains what we collect through the App and related services (the "Service"), how we use and share it, and the choices and rights you have.

By creating an account or using the Service, you acknowledge that you have read this Privacy Policy. This policy applies to the App. Our website is covered by the separate Falken Avionics website Privacy Policy.

1. Who This Policy Is For

The App is offered only to individuals who are at least 18 years of age and located in the United States. We do not knowingly collect information from anyone under 18. If you believe a person under 18 has provided us information, contact us at [email protected] and we will delete it.

2. Information We Collect

Information you provide. When you register and use the App, we collect:

• Account information: your name, email address, and telephone number.
• Optional content you choose to create or store: aircraft profile(s), flight logs, pilot logbook entries, and checklists ("User Content"). You control whether to create or sync this content.

Information collected automatically. When you use the App, we collect:

• Diagnostic data: crash reports and error logs in pseudonymized form, used to diagnose and fix problems.
• Registered-device identifiers: identifiers for the devices on which you register the App. We use these to administer device registration, enforce the per-account limit (two iPads and one iPhone), control access to data downloads and real-time data, and secure your Account.
• Basic usage statistics: limited information about how features of the App are used, to help us understand and improve the Service.

Location. The App accesses your device's location to provide navigation and situational-awareness features. We do not perform real-time location tracking. Location is processed on your device and is not transmitted to Falken during flight. The only location-derived information that reaches us is contained in a flight log, which is uploaded to your Account only after a flight has completed, and only if you have flight-log syncing enabled. You can disable location access in your device settings, though doing so will limit core functionality.

We do not collect payment-card numbers. Payments are handled by Apple, as described in Section 5.

3. How We Use Information

We use the information we collect to:

• provide, maintain, and secure the App and your Account;
• store and sync your User Content across your registered devices;
• enforce device limits and prevent unauthorized or fraudulent use;
• diagnose problems, monitor performance, and improve the Service;
• communicate with you about your Account, transactions, and service-related matters; and
• comply with law and enforce our Terms of Service.

We may send you product or marketing emails only where permitted; you can opt out at any time using the unsubscribe link or by contacting us. Service and transactional messages are not promotional and may still be sent.

4. We Do Not Sell Your Information

We do not sell or rent your personal information, and we do not share it for cross-context behavioral advertising. We use the information solely as described in this policy.

5. How We Share Information

We share personal information only in the limited circumstances below.

Service providers (sub-processors). We use trusted vendors to operate the Service, and we share information with them only as needed to perform their functions:

• Cloudflare — hosting, content delivery, and network/security services.
• Apple — App Store distribution and processing of subscriptions purchased through the App Store.
• Amazon Web Services (AWS) — transactional and service email delivery.

Legal and protection. We may access, preserve, and disclose information if we believe it is reasonably necessary to comply with law or legal process, to enforce our agreements, or to protect the rights, property, or safety of Falken, our users, or others.

Business transfers. If Falken is involved in a merger, acquisition, financing, or sale of assets, your information may be transferred as part of that transaction. We will seek to ensure any successor honors this policy.

Aggregated or de-identified data. We may create and use aggregated or de-identified data that cannot reasonably be used to identify you.

6. Third-Party Aeronautical and Map Data

The App displays aeronautical, weather, and mapping content from third-party sources, which may include the FAA, the Aviation Weather Center / NOAA, the Iowa Environmental Mesonet, OurAirports, AOPA, and OpenStreetMap. This is reference content delivered to your device; it is separate from your personal information and is not a means by which those providers receive your identity from us. 7. Data Retention

We retain personal information for as long as your Account is active and as needed to provide the Service, then for any additional period required to comply with our legal obligations, resolve disputes, and enforce our agreements. You may delete your User Content and request deletion of your Account as described in Section 9. Some information may remain in backups or logs for a limited period after deletion, and we may retain aggregated or de-identified data.

8. Security

We use reasonable technical, organizational, and administrative measures to protect personal information from loss, misuse, and unauthorized access. Your Account is protected by a password; you are responsible for keeping it confidential and for signing out of shared devices. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

9. Your Choices and Rights

Access and correction. Through your Account settings you can access and update your name, email address, telephone number, and User Content.

Deletion. You may delete your User Content within the App and may request deletion of your Account by contacting [email protected].

Marketing. You may opt out of marketing emails at any time via the unsubscribe link or by contacting us.

State privacy rights. Depending on your state of residence, you may have rights to know, access, correct, delete, and obtain a copy of your personal information, and to be free from discrimination for exercising these rights. This includes residents of California (under the CCPA/CPRA), Texas (under the Texas Data Privacy and Security Act), and other states with comparable laws. We do not sell personal information or use it for targeted advertising. California residents may also request that we not disclose personal information to third parties for those third parties' direct marketing purposes. To exercise any right, contact [email protected]; we will verify your request and respond within the time required by law. You may use an authorized agent where permitted.

10. Cookies and Analytics

The App uses limited diagnostic and usage measurement as described above. The companion Web EFB and our websites may use cookies and similar technologies for authentication, preferences, and basic analytics; you can control cookies through your browser settings. The Service does not currently respond to "Do Not Track" signals.

11. Changes to This Policy

As our Service and applicable laws change, we may update this Privacy Policy. We will post changes and update the effective date, and for material changes we will provide notice through the App, by email, or by other reasonable means. Your continued use of the Service after changes take effect means you accept the updated policy. Information collected previously remains subject to the policy in effect when it was collected.
